Manfred Nowak

The U.N.'s Manfred Nowak tells Rick that a future trial could focus on G.W. Bush and Donald Rumsfeld! (Getty Images File)

Should the Obama administration persue criminal charges against people close to George W. Bush? What about the former president himself?

Rick's guest says not only, "Yes", but that Obama is obligated to do just that.

He is Manfred Nowak, the Austria-born United Nations Special Investigator on Torture.

He says evidence exists that shows Donald Rumsfeld et al. clearly knew that they were authorizing torture against terror suspects at Guantanamo Bay.

Watch this exclusive interview and add your comments.

Oh, and apologies for the bad audio quality in the first part of this clip. Stick with it...it gets better.

hi Rick,
thanks for the report on Rush yesterday. i love u. u always say it the way it is.

Brad   January 27th, 2009 2:42 pm ET

Get real people. If Obama tries to bring charges against Bush and his administration, it will be no time at all before the Republicans try to bring charges against Obama. And, we know Obama and his Chicago croonies will not stay squeaky clean for long. It will be an ongoing event every time there is a new president.

Rian McMurtry   January 27th, 2009 2:55 pm ET

Yes. We should clean up our own mess. We need to bring the people who committed war crimes in our name to trial ourselves if we are to claim moral leadership in the world, and not wait for the UN to do it. If that includes clear charges against a former president...even a current president...so be it. They have no one to blame but themselves.

Show some respect Rick Sanchez, that's President Barack Obama to you and everyone else who tries not to give him the respect which is due.

Bill in NC   January 27th, 2009 3:16 pm ET

I would like to know does Rick Sanchez, Patricia Murphy and other CNN anchors have a problem calling President Obama "President Obama"? This is very disrespectful and this did not happen when they reference George Bush. Thank you

Cooper66   January 27th, 2009 3:19 pm ET

If anyone charges bush and his admin. It will show how conflicted the u.s. Is and it will show other countries how weak we are to fight among ourselves. Bad idea!

Ali   January 27th, 2009 3:21 pm ET

Rick,

I feel like we are waking up from a nightmare that lasted for 8 years. We finally have a president who has respect for the rest of the world. I know we will be ok...but i wonder if we will ever recover from what has happened over the past 8 years...

Harry Lime   January 27th, 2009 3:22 pm ET

I think Manfred and others like him are a manifestation of Austrian guilt for producing Hitler and destroying a continent. Let people with clearer heads prevail.

Portia Eason   January 27th, 2009 3:23 pm ET

Why don't you refer to our president as President Obama?

ed klein   January 27th, 2009 3:24 pm ET

I am not usually able to watch any TV in mid afternoon but today I am on vacation and it started to rain. I see why so many people have told me that they cannot watch Rick Sanchez. He does not or cannot keep his hands from being televised. In a few minuted he could not stop making gestures and it seemed like he was all hands.

Portia Eason   January 27th, 2009 3:25 pm ET

Why don't you refer to our president as President Obama?

zack   January 27th, 2009 3:25 pm ET

I doubt Bush will ever see any charges or Rumsfeld either – Manfred Nowak, said it himself that all the Nations Special Investigator on Torture can only ask the Obama administartion to bring charges since the torture hapened on U.S. soil they have no authority to bring any charges and can only ask and Obama will never do that.

Bryan   January 27th, 2009 3:29 pm ET

Instead of focusing on what went down in the past, President Obama should worry about what he needs to do now. Punishing Bush will not fix our economy, not help any of the situations in the Middle East, or anything of that nature.

Jeffrey Smuzinick   January 27th, 2009 3:30 pm ET

They call news conferences because they are use to talking their way out of trouble. They think if they keep talking they will not be punished.

David   January 27th, 2009 3:39 pm ET

Of course criminal charges should be pursued. There is a stack of criminal acts that would be irresponsible to ignore in the legal sense.

Luc   January 27th, 2009 3:39 pm ET

Yes Bush must be put on trial and prosecuted along with other guilty members. As for Blagoyavich, there is a famous saying. If you do bad onto another and make up for it 10 fold, then the past should be forgotten. Bush has not done much to make up, but Blago has obviously done more.

Rick, in regard to your question before break: " It's because I am WHO I am that rules and reality are suspended. I don't live in the same world with the rest of you people!"

David   January 27th, 2009 3:44 pm ET

Regarding Blago, when you say, "some people just seem unaffected" by lying, you are describing psychopathy, which is the absence of conscience and empathy. The public is misinformed about psychopathy and how common it is. Psychopaths create their own realities - they believe they're always right. They will not fail a lie detector test. They serve and protect only self (and those useful to them). They accuse others of their own crimes. Blago shows all the signs. I only wish this behavior would be called out for what it is.

Robert R of Texas   January 27th, 2009 3:46 pm ET

Rick, this whole idea of going after Bush over actions he approved back in his administration is a bit over played. First off, under the new guidelines accessed by Obama, Torture has been more clearly defined. However, under the bush doctrine, some of the actions taken at Gitmo were not viewed as torture. So, because the rules have changed and we are no longer viewing certain actions as allowable, I don’t believe we can go back and say that they were wrong. We can only judge Bush in accordance with the rules made during his administration. In short, though illegal now, the actions were not illegal then. He therefore cannot be tried for criminal actions.

Rick, Ill. would have been a lot better off if Blogo worried as much about his states financial concerns as he does his own.

Are you kidding me? Your with the terrorists Rick and all your drive by media. This country has gotten so far away from reality because of people like you and the drive by media. I can read you like a book and all the rest of your buddies on Cnn. This country will fall because of people like you have no clue on which way to lean. Why dont you start with morals, and doing what is right. Who am I to say what you are though. God will judge us in the end. Your a joke and so is every single news station on public television. People listen to people like you because why? You went to college? Oh yeah if you go to college you know it all. Sorry Rick but you and all your buddys are wrong and are failing the people of this country. I'm wasting my time here because you people are so left and will make me out to be a fool. Maybe I am. Question? Why is it that so many Democrats are getting caught up in scandals? I'll leave it at that. P.S. No morals, no conscious, all out for themselves, all a lie, you are all jokes. ha ha ah. joke will be on you.

Jim Silks   January 27th, 2009 3:49 pm ET

How can the republicans say they have the aqnswers to the bailout when they were a rubber stamp for the one who caused this ecomny. Lowering taxes for businesses without stipulations didn't work for Reagan or both Bushs and it won't work now!

Barry   January 27th, 2009 3:49 pm ET

I agree with louis 100%. These people WE put into office are EXPECTED to be held to a higher standard..

Prasad   January 27th, 2009 3:51 pm ET

Rick, I have a suggestion. Why don't we design our computer programs in such a way that we can replace governors, presidents etc with computers that decide what's best for us. It seems like people with emotions seem to keep getting in touble everytime they enter the office.

Phyllis   January 27th, 2009 3:51 pm ET

Doesn't Congress have anything better to do than worry about the past. Although I think Mr. Bush was the worst, I'd rather Congress deal with present problems and not waste time and money going back to the issue of fired attorneys. That won't help us in our present situation.

Jackie Siefers   January 27th, 2009 3:52 pm ET

Perhap Blagoivich took his lead from Bill Clinton when he committed perjury and nothing was done to him. He didn't take into consideration whether he was liked or disliked by the press. Makes all the difference in the world. Bill Clinton's crime was just as serious, but he got a pass. Perhaps you guys need to have a set standard and not be so bias.

albthere   January 27th, 2009 3:52 pm ET

Thank you for calling our president by his profession and not just by Barack or Obama or Barack Obama. He is now President Barack Obama. He worked very hard for this title and out of respect it should be used just like your doctor and the professor that was on your show earlier.

Franklin Banker   January 27th, 2009 3:53 pm ET

The inside team from the Bush administration is accountable for their actions concerning the illegal transport and torture of terrorist suspects. Since WWII, the Geneva Conventions apply, even though they told us all then that the conventions did not apply.

I agree that Obama and his reform team must prosecute all who were involved. Bush, Cheney, Rumsfeld and the CIA chief at the least. Others will certanily be named. I am all for their being held accountable through the Congress, the DOJ or whatever legal body can do it.

I am so happy Obama was elected. He is already shaking things up. I truly believe our nation has been under a dark cloud under Bush. Now the light is shining, and many citizens like me want the truth told, revealed and acted upon.

We cannot act in a manner that is more reprehensible than those who would be our ememies would act.

joey in South Point   January 27th, 2009 3:56 pm ET

True.. What do expect a democrat to do when the so called "GREATEST" president ever(Bill LIAR Clinton) gets away with purjury, every other one of them are bound to try it!!

Prasad   January 27th, 2009 3:57 pm ET

This is fascinating that we are soo much into punishing everybody in US that without a trial, this governor is already labeled guilty. Is this still United States of America? Is there no such thing as innocent until proven guilty anymore? Did former president BUSH remove that as well or do people just want to be more and more UN-American.

Teresa   January 27th, 2009 3:57 pm ET

While everyone is criticizing business for buying jets, is anyone thinking about the thousands of Americans losing their jobs in the aircraft industry?

Bozzy   January 27th, 2009 3:57 pm ET

Mentioned the seeming glibeness that is evidently FOUND TO BE ACCEPTABLE these days..shades of Palin and others , unfortunately too many others and Blago is but following in their steps.
Seems for eight years, the glibe spinnings beguiled the citizenry enough to keep all at bay and even fear that to hold any of these electeds/selected accountable , well, tantamount to treason especially in war time we all were told as they told us just to keep tursting and supporting them and theirs implying THEY would NOT lie –Pretty words hyped up and spun to point it was dizzying and difficult to keep track of ever so much. OUR systems/minds were overwhelmed and it came off as unable to have any meaningful recourse anyway.
Look how Caroline was dissed for being a POOR public speaker on gibberished nonsense (little regard to REAL issues of which she was asked very little ) Shredded for her uhs/ and you knows no matter how sincere in intention to serve the people and not just be selfserving . What we get left with , such as Blago's and so many similar found in the bushler brigade. TIme to seek more than flash and bladerdash, we do need folks with the heart, mind and soul to REALLY serve the citizenry, its up to us to demand it and have such enforced.

V. Harris   January 27th, 2009 3:58 pm ET

It seems , the Republicans are using the old motto "Just say No!!!"

Dennis Spinelli (California)   January 27th, 2009 3:59 pm ET

The key in my opinion, to this bad economy ,it's the REAL ESTATE MARKET. The white house should intervene and stop all foreclosures and have banks to work with home owners to modify their loans to a much lower payments. When people stop worrying about their homes then they will feel more confident about our economy.

Herman   January 27th, 2009 4:01 pm ET

Rick after stumbling around for years trying to find yourself I think you have finally hit a home run with this show. Good Luck.

Felipe   January 27th, 2009 4:01 pm ET

I would like to see Pres. Obama lifting the Cuba Embargo to show the Latinamerican countries and the rest of the world that he means change. He can gain a lot from Latin America by lifting the embargo. Let's do away with the old school and stop demanding conditions to democratization of Cuba. China and Vietnam are communist and we do business with China and Viet Nam which are more of a threat to the USA and their human rights abuses are increadibles, why not lift the embargo to Cuba that is not a threat to us. It is amazing that the Cuban Americans in Florida hold hostage our foreign policy.

Think about it, the Cuban embargo has been there for 50 years and nothing has changed in Cuba. Perhaps if we lift the embargo, then we will see change.

Thanks

barbara   January 27th, 2009 4:03 pm ET

i dont get why we are still talking about bush he keep the country safe by any means ok thank you and good bye thats all we should have to say to the man.

Jose E. Jose   January 27th, 2009 4:04 pm ET

So Ricky, after all those years in office we are going to finally put that W's guy in jail? I don't like that he got away with unsolicited torture. I means if it is asked for in the first place like I do on a constant basis from me lovers, then I think it is alright for the Guantanamo's to stay there. I know if you were conducting the torture there that I would be on the first flight to the Motherland.

sheila from colo   January 27th, 2009 4:05 pm ET

Our country cannot afford the cost (monetary and emotionally) to try the bush adinistration. We need to get non-americans off the payroll so that money back to be used here, most illegals send a lot of their money back to their country,as do the people working here when their family is elsewhere.

we need to push education so that we don't get into this mess again.

Prasad   January 27th, 2009 4:08 pm ET

I can't believe that American's actually believe that their ecomony is bad. Guys seriously, think about that. I am sure you guys pay bills as well, what do you think will happen if you give all the money you make to your friends and family, what do you think you will have left to pay your bills with ? What do you think we are sending to Iraq and Afgan, fruits and vegetables ? come on seriously guys. How much do you guys think we send to Iraq and Afgan, and now go find out how much U.S makes a year. We are still doing OK, not too good but still ok, the only problem is the money is going out of this county and there is nothing coming in.

James Orellana   January 27th, 2009 4:09 pm ET

Why is the press secretary wearing a pink tie? The Republican Party is drunk with tax cuts. It is deregulation that got us into this mess. Lets pass a better mix of investments with creating jobs and tax cuts. James

Mark   January 27th, 2009 4:12 pm ET

Let it go. He had one of the most challenging presidencies ever and handled it well given what he had to work with. 911, 2003-2007 record growth and job creation – then the subsequent bust that always follows a boom. He kept us safe for seven years and it is interpreted as being arrogant. Should he have shared all the ways in which the administration was fighting future attacks with the terrorists?

I thought this was about the future???

Dennis Spinelli (California)   January 27th, 2009 4:13 pm ET

I think Press.Obama should run this Country like Europeans do. Invest in education and health care.

debbie penticost   January 27th, 2009 4:16 pm ET

citimortgage has 45 billion $ of OUR money. why can't citi use the money to directly pay off mortgage holders notes?? 150,000 notes would be paid that are at least say $300,000.00 or less. when the notes are paid there will be spending, which means jobs will prosper. there wont be empty homes all over the united states. SO if all mortgages companies do it also, we will be back to normal immediately!! not in 18 months or 5 years from now. IS IT NOT OUR MONEY? OUR CHILDRENS MONEY? OUR GRANDCHILDRENS MONEY?

Prasad   January 27th, 2009 4:20 pm ET

I think all President Obama has to do is repair all the mistakes of former dictator Bush and U.S would be back to normal.

Almer Docena   January 27th, 2009 4:21 pm ET

Hi Rick,

Yesterday you discussed about torture. I think some small business are practicing this king of political activities and I experiencing this my self. One example is isolating from friends, families and co-workers, know pattern of my whole life etc. and use this for profitable purposes. I want to discuss this with any body but look like they are anywhere, and some agencies are involved. I do not know who to trust.

Almer

Dennis Spinelli (California)   January 27th, 2009 4:22 pm ET

The stimulus plan is just a welfare plan. They should concentrate in giving small buss, more tax incentives and bail out all home owners that are loosing their homes. and create more long term jobs.not a quick fix for a long time problem.

albthere   January 27th, 2009 5:51 pm ET

We only hear the "quote" small select conversation from the prosecutors on blagojabich. Are we going to listen to the whole tapes , like he is asking? Why don't they play the whole tapes? are they cover for some important politicians?

Nancy   January 28th, 2009 3:00 pm ET

Rick,
Informative segment with Manfred Nowak. Current law may indeed oblige Prez. Obama to explore Bush & Rumsfield – among others – for war crimes. However, ultimately I believe that Obama will pardon any wrongdoings by the former administration as is so commonly done when administrations change.

Obama has signed an order for 'no more torture'. Problem addressed. The economy, jobs, banks must be his main priority right now.

Naeem   January 28th, 2009 3:10 pm ET

I'm surprised George Bush hasn't had to face a lawsuit yet. He's walking a legal tight-rope right now, with an elephant right behind him.

Jim Bridgman   January 28th, 2009 3:16 pm ET

Tax credits for payroll taxes? Non-negotiable!! This is so those that are currently paying zero income tax can have a credit also, but last time I checked for the past twelve years all I have heard is that Social Security is in danger and needs to be modified to make it solvent. So tell me exactly how giving a credit for payroll taxes and transferring the debt from SSA to the national debt is benefitting the country?

Shirley   January 28th, 2009 3:16 pm ET

I think George W. Bush should be put on trial for a war against a country that did not attack the USA, and for all the lost of money spent in Iraq senselessly. It is ok to go to Afgahnistan after 9/11 and attack looking for Bin Laden, but not Iraq. And while it was ok to go to Afgahnistan then it is not ok now for us to be still there, we need to get out of these people country, lets just think if it had happen to us. And we seem to be getting close to maybe a place like China doing to us the semm thing when we cant pay them all the money that we owe them. How would we like that?

Sam Gibson   January 28th, 2009 3:17 pm ET

Umm..Bush & Rumsfeld ONLY? Let's not (EVER) forget the person who acted as Bush's brain (seeing that he doesn't have one), Dick Cheney, along with prosecuting contractors such as KBR for not Neglegent Homicide but ALSO for murder. It's bad enough that our soldiers went to Iraq in the first place-it's equally bad that a greedy contractor who either cut corners or simply didn't do their job at all & it wound up in multiple deaths. My goodness-how DARE these soldiers want to take a damn shower!

D.Cornejo   January 28th, 2009 3:18 pm ET

If we do not follow through with the prosecution of criminal behavior by our leaderhsip, how can we maintain our respect in the world. If we don't handle it. The Hague will and should.

Dale L. Flanigan   January 28th, 2009 3:21 pm ET

Rick,

I believe idiot George and his administration should be charged with war crimes and acts of terrorism for invaiding sovernign nations with out due cause. He has cause the death of our military personell and innocent civilians through the world......

roger   January 28th, 2009 3:26 pm ET

naaaa thats a big waste of time lets forget about bush and leave him alone and move on

Shirley   January 28th, 2009 3:31 pm ET

Rick I wonder why the Republicans did not have all these bright ideas during Bush Administration to create new jobs when, they began sending ours over seas. This Boehner should just do the damn peoples work in helping to stimulate the economies and creating new jobs and stop playing games with our lives. Now is not the time to talk shop we heard that all last year now is time to put your money where your mouth was, in your promises. As for our men going to work overseas for these terrorist, i dont blame them for taking work where they get it, but what kind of American are you to go train just to come back to fight America? I would take pleasure in killing these dogs. We need the NRA more now than ever.

JIm   January 28th, 2009 3:31 pm ET

Have we all forgot that 9/11 was an unprovoked attack on innocent Americans and it cost us 3,000 lives? Should we prosecute Bill Clinton and his administration for failing to capture or kill Bin Laden before 9/11? Should Bill be prosecuted for deriliction of duty that lead to the deaths of our citizens? The answer is No and we should not be attacking the people who did what they did to keep us safe.

Most Americans are clueless as to what it truly takes to keep this country safe, to secure and protect their freedom. We are so fast to attack our leaders and those brave enough to defend us and are so quick to forget those that actually attacked us. In my opinion it is unamerican to even consider prosecuting those that defended and protected us, including President Bush.

Why does CNN concentrate on issues like "Pastor Harrard" and his sexual exploits. I am A Pastor and he should not even be called A Pastor. He certainly not GOD'S leader. The Bible clearly states that all sexual immoarlities, "HE/GOD" hates. The general public needs to hear more on the economy/job lost, foreclosures, why The "Ole Boy" Republicans are allowed to have "photo ops" regarding President Obama's Stimalus plan. I find it interesting that all of a sudden–the Republicans have all the RIGHT answers to our economic problems. Quite frankly –they had the opportunity during the Bush administration. Why were they all silent for soo long---Now– all of a sudden they have had an economic epiphany????? QUESTION- Where were you for the last 8 years? Why did you let it get to this point? Are you voting for or against the new stimilus for programs-jobs etc based on the desires of the people in your state? or –are you doing your own biased thing?

Jan W from DE   January 28th, 2009 3:41 pm ET

If we are to regain our reputation as a fair and just nation, Obama has to follow up his Executive Orders by ordering an investigation into Bush Administrations methods to determine if they meet the definition of torture and then to allow international authorities to prosecute whomever it determines may be guilty. To those who say it would embarrass America, I say we have already been embarrassed and these are wrongs which must be brought to light and punished. To those who question my loyalty, I do not have to be loyal to bad people no matter who they are. To those who say Bush's tactics spared us another attack, I think it created more terrorists. Time will tell.

D.Cornejo   January 28th, 2009 3:46 pm ET

How dare you blame Clinton! He was an excellent leader. He left us witha balanced budget, a booming economy, a financial surplus and world respect. 9/11 happened on G Bush's watch. He chose to ingnore the warnings of the outgoing intelligence. Most likely on purpose, so that he would have a made up excuse for the power grab that insued. He and his administration are criminals and should be treated as such. Get the screams of a these bankrupt ideas out of your head. The conservative experiment has failed.

About, Omar Jamal. The guy who was claiming he is with Somali Justice Advocacy, I want let you know there is nothing called Somali Justice Advocacy which registered under the government of Minnesota on other hand Omar doesn’t have any concrete to prove the allegation he had from other Somali American kids, I wish you watch out what you are broadcasting.
Omar Jamal and his organization doesn’t have any actual mailing address and they share someone ‘s contact address, just in order to collect some money from the government of United States.

Let him come up any legitimate prove of the contacts that kids made from Somalia

3 words: INTERNATIONAL WAR CRIMES. They're all guilty as hell. They need to go on trial, and if the Obama administration doesn't see to it, they will not only be avoiding their constitutional duty, they will be accessories.

This country is in a mess. And we can thank Bush Admin and the republicans.I would like to say to move on but if Pres. Obama really wants to show the world that we want change then he needs to look and look close at the policies that Mr. Bush and his cronies have made. If they show in any way they are against our constitution then they need to be prosecuted. The longer we wait the worst it looks for this country. And the GOP needs to wake up to what they have done to this country. They are so out of touch with us it's unreal. I have heard alot how they are complaining about the new law that allow people to join unions to get more money . One republican said that it would be the end of this country if that was to be legal. We you rich republicans have screwed us over for the last time. And the election should be a warning to all of you. Your time is limited. If anyone votes for any republican in the next election you need your head examine. I am 60 years old and I have worked everyday of my life. And now when someone is willing to help the middleclass you are calling it socialism. I bet you more that half of the Americans in this country would agree that we have taken enough from the trickle down effect. You have gotten richer with all the tax cuts and loopholes. You were suppose to create more job.Where are they? The only thing I see is greed.

Linda in Arizona   January 28th, 2009 4:01 pm ET

And, as others have mentioned, please call him "PRESIDENT" Obama. You are not the worst offender. I have written many times to the Situation Room, AC360, and others. It was always "president" bush. Show some respect for someone who actually deserves some.

Michael DeBoeuf   January 28th, 2009 4:11 pm ET

This Administration has been guilty of breaking many laws and Human Rights violations against it's own citizens. Mind Evasive Technology has been used extensively in this country for many corrupt reasons. This is the same technology that Harlan Girard has been trying to expose. The use of this technology has fallen into the wrong hands. This is probably why our economy is in shambles. Does anyone actually realize what is really going on in our country anymore!!!

Cindy   January 28th, 2009 4:13 pm ET

Rick,
I have a couple of different topics I want to ask about. First and foremost, Obama's first action was to push for the close of Gitmo. My questions are this: Will closing Gitmo create jobs or stimulate our economy? How much will closing Gitmo cost from this "recovery package" Obama has attempted to push through? How long before we face another Cuban Missle Crisis by closing Gitmo? With this HUGE recovery bill Obama has push for banks to be bailed out. Question here is WHY did we give recovery money to bank whom have been found guilty of manipulating the american people's accounts to cause "NSF" charges to increase their income? Why hasn't the smaller banks such as WaMu and the like been getting ANY assistance from the U.S. Government, instead they allowed them to be bought out or go bankrupt. Why hasn't Obama stepped into the Big 3 conversation and delt with THAT problem, which solving that one in itself would possibly get many americans back t work. Forcing a complete rebuild of the UAWU would be a step in the right direction! NONE of this "recovery" money seems to be going where it's needed most, INTO THE U.S. ECONOMY, instead Obama seems more worried about rubbing elbows with foriegn nations and ensuring that they are content and happy. What about the American people here at home? What does he plan to do about the suicide rate job due to job loss, or the young kids killing each other daily in our streets because they think its a means of survival. Obama has failed to see the private war we have going on in our OWN country, he's failed to see that we don't need to save everyone else before saving ourselves! STOP allowing inmates of death row to continue to sit there after 10 yrs, they were put there and had their appeals, now its time to USE the system which was created in essense to KEEP ORDER, and discourage criminal acts! Simply put...Obama needs to save us before worrying about saving everyone else half way around the world!!

Cindy   January 28th, 2009 4:31 pm ET

Rick,
One more question that I forgot to address, Credit Card/Loan companies "poor business practices". Many americans have addressed this in recent weeks/months, wondering WHY these companies have NOT been investigated for their illegal activities. Many consumers have complained about Credit Card/Loan companies changing their due dates at the last possible minute, to cause immediate and VERY HIGH increase in APR %..Why has the government NOT looked intot his? Why has this topic been so neatly swept under the rug?

Concerned one   January 28th, 2009 4:36 pm ET

If Bush has to go up in charges ,so should the Congress

Chris   January 28th, 2009 4:44 pm ET

I believe that torture would fall under the Geneva convention. Never have I ever been so ashamed to tell people I am an American because of this torturing of POWs. If I was ordered to torture a POW I would have told my official to kiss my azz and go straight to hell. I might have been put in prison but I would have been able to sleep at night knowing I had nothing to do with the torture of another man.
I believe that everyone involved with the torture, rather they were ordered to do it, the ones ordering it, or anyone that knew it was happening and had the authority to stop it and did nothing to stop it should all face war crimes and be sentenced to the maximum sentence, should they be found guilty. I also believe they should be held without bail and none of them should have the opportunity of clemency for turning states evidence.
I believe if there is a law written that says the Obama administration is to start an investigation on these matters, well then Obama needs to appoint someone to investigate it. How long could it possibly take to say, Mrs. Clinton please investigate this matter...or whomever he chooses. Took me less than 1 minute to type it.

Jim   January 28th, 2009 5:13 pm ET

The first attack on the world trade center was in 1998, the Clinton administration missed many opportunities to capture/kill Bin Laden. What short memories we have. There is no anger over those who attacked us, that killed 3,000 Americans. No, we attack our leaders. 9/11 defined the Bush administration, I hope that another attack does not define Obama's.

After serving 21 years in the U.S. Army it scares me to read such anger and the questioning of how those who defend this country do it. What do you propse, cease all combat operations, train our forces on how to administer the miranda rights? Submit request for search warrants? Who's rights are more important, the right of Americans to live or those that have attacked us?

We are not policing the streets of America here, we are fighting an enemy that does not acknowledge your rules or moral ideology and to defeat them the gloves must come off, it not only ensures our victory but it also ensure the safety of our nation.

It is always those that have never sacrificed anything that cry the loudest and attempt to define the rules that others must follow. President Bush did what needed to be done, he took the gloves off and allowed those charged with defending this nation to do just that and most importantly he stood behind us and was unwavering. The President took an oath to protect and defend this nation, President Bush took that oath to heart as he should, as every elected leader should.

Get off your soapboxes and stop second guessing what others do to protect you while you sit back in comfort and safety and complain about them. Freedom is not free and war is not fought by rules that you would like to see set.

rita nalette   January 28th, 2009 6:21 pm ET

i wonder if the judges leftover from the Bush Administration will permit it.... the following is my experience with the Bush Administration.

I voted twice for George W. Bush. I am a Republican and we do that. I watched as, under his watch, my country was so seriously injured as to be on the verge of destruction. My heart was broken and then I became very angry. I wasn’t going to be silent any longer and while I was just a 59 year old woman operating a cleaning service I was also a child of the ‘60s and a Veteran.

I had read the Constitution and this administration was violating their oaths of office. It cost me $200.00 to file my challenge in The United States Court of Federal Claims (No. 06-355 C, Filed: may 1, 2006, Assigned to: Judge Marian Blank Horn, Clerk: Brian Bishop). I got the crap slapped out of me but I had fought and it is on record. I am an American and we stand up and fight when we see a wrong being done.

Election 2008 – I listened to Senator Obama. I watched how Senator and Mrs. Obama carried themselves. A small ember glowed as this clean, intelligent and articulate man spoke. I don’t want or need my president to do anything but represent my country to the world and not shame me in my house. I am so proud to have voted for Senator Obama and to have gained Senator Biden as well.

D.Cornejo   January 28th, 2009 7:11 pm ET

The republicans in Congress are corrupt and very worried that their gravy train (lobbyist $$) is going to pull into the station. They also have given billions to their cronies in the military industrial complex as well as the Banks. They have jumped fare, and are soon about to face the transit cop- Obama and a fed-up populace. They have had no oversite or conscience when they were in power, now they expect to set the agenda. Now they scream about debt and bailouts? WOW! what cajones. Their obstructionisitic behavior may cause the further disintegration of the republican party. I can only hope that justice will prevail.

allen maes   January 29th, 2009 3:58 am ET

It doesn't take much to research and to look into when an ex-president could believe he was above the laws of the people and humanity, Re: Nixon.
Now we just got rid of another one that can still justify the torturing of POW's. Let's finish the job of serving justice and put Bush and his crooks and cronies behind bars and set a real example and show the people of the world we will not tolerate inhumanities no matter who's war or what kind of war is being waged. Isn't any war bad enough or have we come to expect it as a normal way of life?

According to our beloved Constitution, Bush and Cheney can still be impeached. Why won't Pelosie and the rest of our congressional members develop a backbone to do their jobs. Richard H Wallace   January 30th, 2009 2:54 pm ET

Dear Rick:

Many of our elected congressional officials, Democrats and Republicans, plus our President, are emphasizing the desire to be bipartisan in pushing thru an " emergency" stimulus package. Again it is geared more to taking more care of the banks, whose greed and often illegal actions have precipitated this entire economic crisis.

Instead of bickering about bipartisanship(which hasn't actually existed for countless years),why aren't the Democrats and Republicans working together passing economic packages for the severely strapped middle and poor classes that they also claim to represent.. Instead, they are more interested in pursuing bailout packages for their cozy buddies on Wall Street and in the banks! Empty words are just that!

But then again, it is becoming quite obvious to many under represented, non-wealthy Americans, why the bailout money has, and will continue to be, earmarked to the banks and Wall Street.. After all, it is a fact that most of our elected officials accept huge sums of money from lobbyists who represent the banks and many other large business entities, in order to finance their bids to get reelected. In this country, the only goal of this vicious and repetitive cycle orchestrated industrial/financial/military complex, is to perpetuate the rich getting wealthier, while shrinking the middle class and increasing the misery of the poor.

As the so-called American dream is quickly slipping away for many Americans,, it should not lost on our elected officials that history has a way of repeating itself. After all, as I write, France's national government is experiencing mass street demonstrations by millions who feel that the government is taking more care of the banks, rather than the needs of the people who provide the backbone of their country.

Yes, this same behavior is even quite feasible in America! Our federal government should not make the serious mistake of ignoring the needs of its people who are experiencing increasing despair, and deceasing hope. In the near future, it is quite conceivable that a crowd of millions could be protesting in the Washington Mall and on the Capitol's steps, in order to get their concerns heard, and their needs met during this economic crisis? Time will tell if our new president and partisan Congress have the needed guts to take more appropriate actions for the good of its people.

Rick, don't you believe that the media's political consultants, reporters, and anchor personnel, should be more interested in these issues? Furthermore, don't you also believe the media should be holding US Attorney General accountable for actively pursuing and prosecuting those greedy banking individuals who committed fraud, while issuing ethically wrong home mortgages to countless unaware Americans? If the media fails to followup on these subjects, I think that they are failing in a major responsibility they have with the American public.

Lawrence   January 30th, 2009 3:35 pm ET

Dear Rick,
Without a doubt Geworge W. Bush shluld be put on trial for war crimes. Shock and awe, the kick-off to a brutal war in which thousands of Americans and Iraqis were killed, was launched by Bush upon the Iraqi people without any good reason. All the excuses he proferred have proven to be totally false. There were no weapons of mass destruction, Saddam Hussein was not imvolved in 9/11, Iraq had no capability to attack the US. Bush and his neocon henchmen manipulated intelligence to promote their foolhardy agend of remaking the Middle East and should be held accountable in a court of law. They include Bush, Cheney, Rumsfeld, Rice, Wofewitz, Perle, and Feith.

So much destruction and human suffering resulted from their actions that it would be a further crime against humanity not to bring them to trial.

It has also become clear that Bush and his top lieutenants in the White House authorized torture against prisoners captured in the "War on terror". There is no doubt they knew exactly what they were doing, Cheney admitted that he still feels it was right to torture them. Cheney and Rumsfeld and their accomplises should be tried on charges relating to their flaunting of the Geneva Conventions on treatment of prisoners. of war.

Great harm was done to our country by the criminal Bush administration and it would cause more harm not to punish those who broke the law.

We are nation that professes the need to observe the rule of law. How can we continue to claim that we are a nation that honors our judicial system if we do not hold everyone accountable to the law? Now, more so than in all of this nation's history, it is important that we demonstrate to the world that our laws are for every person, with no special priviledges for the rich, or the political and corporate giants.

While Obama has more to think about with a war and a depression going on. The fact that Obama is in office and that the Democratic takeover of House and Senate shows that not only people are tired of the way things are, but want to hold up our leaders to ethical values of responsibility. For Obama to simply allow this Presidential Privilage so that Bush may decide who testifies against him is not showing the initative of responsibility that I had in mind when I voted for Obama.
I want prosecution of the Bush administration. I think that faith in Obama rests on how he handles the investigation into the Bush administration's breaking of the public trust. Our leaders must be held accountable for their actions. After all Obama, you promised us justice, change and equality.

All the President's discussions with his key advisors should be protected as though they are his lawyers. They should be forbidden to discuss anything unless he give his advanced specific approval. The President needs to be able to make decision based upon the best available information, some of that information may be contrary to the final decision he makes. He shouldn't have to worry about someone second guessing his decisions, after the fact. He needs to make tough timely decisions. Sometime those decisions are going to turn out bad that is were the next election come in.

As far as our image overseas, no matter what we do we are wrong in someones eyes. We need to make the best decisions placing our needs first, if it works out for the rest of the world–great! If not, let them live with it or step in as the world police man instead.

George W. may have not been an Abe Lincoln? He did the right thing after 9-11.
In my short life I've never seen the country in shock like that except when we lost another great President, John F. Kennedy, a Democrat, I wep like a baby.
I could never figure out people who would do such a thing? Now President Kennedy, a great man and his ship mates, all gone now, like Lincoln, belong to the ages.
Like Pearl Harbor but worse, 9-11 shows ya the cowards were fighting.
We lost a lot of good Americans. Bush was there pulling our Country together.
He showed the World, America would not tolerate such attacks. God bless the Boys and girls protecting our country. Makes me proud to be an American. Proud to have Served my Country.
Wonder if the Democrats want some of the Terrorist living in there neighborhoods? Next door etc.
Wonder what the liberials and Democrats think about old Abe as a Repulician, oh yes, he was a President. The Union did survive thanks to my great grandpap 14th Ky Volunteers. Union Army and many a good lad that made it happen.
Lincoln lost his life in the process but we're still all Americans not devided, one America.
Wonder what Ole Abe would say if he knew I married a Gal from Old Virginia? 46 years now, newly weds, still on our honeymoon, still fightin?
As usual, I get hit a couple of times with a Cast Iron Corn Bread skillet my ganny gave her when we got hitched. Helps clear the air and let me know that all you lovely ladies still run the world regarless
who is President!
Like President Obama said, "When Mama's Happy, I'm Happy"
My wife and I renewed our vows in Hawaii on our 40th, isn't it great to live in America? Try the other countries? You'll get my drift.
